DEFINITIONS
As used herein, EARTHTRACES means the EarthTraces Foundation, its Board of Directors, staff and activity leaders, member organizations and suppliers. EARTHTRACES also means its Life Adventures programs, Life Experience programs, Onsite Programs, ETGear products and any other activities it undertakes or that are undertaken with its consent on its behalf.
ASSETS means any EARTHTRACES asset, activity, document, equipment, leader, product, program, property, publication, service, software or website.
EARTHTRACES PROGRAM DISCLAIMER AND WARNING
The individual is responsible for his/her personal safety, training and performing within the limits of his/her skills. The individual must always carefully judge the safety of each activity and the accuracy of any information utilized. EarthTraces programs involve activities that may be dangerous and can result in serious injury or death. Environmental conditions, wildlife, equipment, incorrect information and other participants can become hazardous at any time. EarthTraces makes no warranties, expressed or implied, and all participants act at their own risk.
In no event shall EarthTraces be liable for any special, indirect or consequential damages or any damages whatsoever resulting from damages, harm, loss of use or data or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance (or failure thereof) of any of its assets.
